End User License Agreement (EULA)

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Evermind Tech Ltd ("Company") for the use of PlanSketch UK mobile application ("App"). By installing or using the App, you agree to be bound by this EULA.

2. License Grant

Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal or business use.

3. License Restrictions

You may NOT:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Remove any proprietary notices from the App
  • Use the App for any unlawful purpose
  • Transfer the App to another person or device without authorization

4. Subscription Services

The App offers subscription-based premium features ("PlanSketch Pro"). Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.

  • Payment is charged to your Apple ID account
  • Subscriptions auto-renew unless cancelled 24 hours before the period ends
  • Manage subscriptions in your App Store account settings
  • Free trials convert to paid subscriptions unless cancelled

5. Intellectual Property

The App and all related intellectual property rights are owned by Evermind Tech Ltd. This EULA does not transfer any ownership rights to you. The App is protected by copyright, trademark, and other intellectual property laws.

6. User Content

You retain ownership of floor plans and content you create using the App. You are solely responsible for your content and ensuring it does not infringe third-party rights.

7. Privacy

Your use of the App is subject to our Privacy Policy, available at plansketchuk.com/privacy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

10. Termination

This EULA is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.

11. Governing Law

This EULA shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to EULA

The Company reserves the right to modify this EULA at any time. Continued use of the App after changes constitutes acceptance of the modified EULA.
